These Terms of Service (“Terms”) govern your use of the Email Mavens website and our products and services. By using our site or buying from us, you agree to these Terms. If you do not agree, please do not use the site.
This site is operated by Erica Walter Writes, doing business as Email Mavens. You must be at least 18 years old and able to enter into a contract to buy from us or create an account.
Email Mavens offers email marketing services and education for wineries, which may include done-for-you services, consulting, speaking, digital courses and downloads (such as PRESS SEND and Email Essentials), the Digimatic Starter’s Bootcamp, and the Mavens On Demand membership. Done-for-you services, consulting, and speaking are provided under the individual contract or proposal you sign with us, which sets out the scope, fees, and terms for that work and controls if it conflicts with these Terms.
If you create an account or join a membership, you are responsible for keeping your login credentials confidential and for all activity under your account. Tell us promptly if you suspect unauthorized use.
Prices are shown at the point of purchase and may change. Payments are processed by Stripe. You authorize us and Stripe to charge your chosen payment method for your purchase.
If you buy a subscription or membership that renews automatically (such as Mavens On Demand), it will renew at the then-current price for successive terms until you cancel. We will show you the renewal price and billing frequency before you buy. You can cancel at any time through your account or by emailing us at hello@emailmavens.com. Cancellation stops future charges; it does not refund the current term unless required by law or stated in our refund policy.
PRESS SEND satisfaction guarantee. We stand behind PRESS SEND. If you go through the course and do not produce results, and you can show us that you implemented all of the steps and resources we provide, we will refund what you paid for the course and buy a case of your wine. To make a claim, email us at hello@emailmavens.com within 90 days of purchase or completion with proof that you implemented the course.
Other products. Refund terms for other digital products, memberships, and downloads are as stated at the point of purchase for that product. Unless stated otherwise, digital products and downloads are non-refundable once accessed.
Services. Done-for-you services, consulting, and speaking are governed by the individual agreement or proposal you sign with us, which sets out any cancellation or refund terms.
When you buy a course, download, or membership, we grant you a limited, personal, non-transferable, non-exclusive license to access and use that content for your own business. You may not:

All content on our site and in our products, including text, graphics, logos, course materials, templates, and the Email Mavens name and brand, is owned by us or our licensors and is protected by intellectual property laws. You may not use our trademarks or content without our written permission, except as allowed by these Terms.

Our products and services provide information, strategy, and tools. We do not guarantee any specific result, including revenue, sales, or deliverability outcomes, which depend on many factors outside our control. See our Disclaimer for important details about results and earnings, which is incorporated into these Terms.
To the fullest extent allowed by law, Email Mavens and its team will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or revenue, arising from your use of our site, products, or services. Our total liability for any claim relating to our products or services will not exceed the amount you paid us for the product or service giving rise to the claim in the 12 months before the claim.
You agree to indemnify and hold harmless Email Mavens and its team from claims, losses, and expenses (including reasonable legal fees) arising from your misuse of the site, products, or services, or your violation of these Terms.
Our products may reference or rely on third-party platforms (such as Klaviyo, Commerce7, and others). We are not responsible for those platforms, their availability, or their terms and pricing.
We may update these Terms from time to time; the updated version applies once posted. We may suspend or end your access if you violate these Terms or misuse our products.
These Terms are governed by the laws of the State of Washington, without regard to conflict-of-law rules.
